Because the petitioners were acquitted in the criminal case, the writ petitions seeking to restrain the departmental enquiry were held infructuous and were disposed.

Summary

The petitioners filed writ petitions in 2013 seeking a court order to restrain the Railway Protection Force from conducting departmental enquiries against them while a criminal trial under Section 3(a) of the Railway Property (Unlawful Possession) Act was pending. The criminal case (Court Case No. 50 of 2012) was tried before the Judicial Magistrate First Class, Railway Court, Bhusawal, which ultimately acquitted the petitioners. The respondents submitted the acquittal order, arguing that the writ relief was no longer necessary. The High Court observed that, in view of the acquittal, the petitions became infructuous. Consequently, the court disposed of the writ petitions and any related interim applications.
