Bombay High Court

MOHAMAD HABIB MOHAMAD ISAQ AND OTHERSversusMOHAMAD SK KALIM SK ISAQ

Disposal
DISPOSED OFF

Holding

The Court directed the trial court to hear and decide the original suit on its merits within one year and disposed of the writ petition.

Summary

The petitioners filed a writ petition challenging an order dated 18.04.2017 passed by the District Judge in Misc. Civil Appeal No. 13 of 2017. The petition remained pending since 2017 without any interim orders. Both parties agreed that, given the delay, the interests of justice required the original civil suit (Regular Civil Suit No. 205 of 2016) to be heard and decided on its merits promptly. The Court, without addressing the merits of the writ, directed the trial court to dispose of the original suit within one year from the date of the order. Consequently, the writ petition was disposed, with the matter left open for further points if necessary.
