Allahabad High Court

SHRI RAM AND 2 OTHERSversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The High Court held that it lacks jurisdiction to interfere with the executive magistrate's order under Section 146(1) CrPC and the subsequent revision order, and therefore dismissed the petition.

Summary

The petitioners challenged the attachment of their land ordered by the Sub‑Divisional Magistrate (SDM) under Section 146(1) of the Criminal Procedure Code and the subsequent dismissal of their criminal revision by the Additional District and Session Judge. They filed a petition under Article 227 of the Constitution seeking to set aside both orders. The High Court held that disputes arising from the executive magistrate's assessment under Section 146(1) CrPC are not amenable to judicial review under Article 227. Consequently, the Court declined to interfere with either the SDM's order or the revision order. However, the Court directed the SDM to expedite the pending case and decide it within six months, and the petition was disposed of.

Issues considered

  • Can the High Court, invoking Article 227, interfere with an order passed by an Executive Magistrate under Section 146(1) of the Criminal Procedure Code?
  • Whether the revision order of the Additional District and Session Judge can be set aside on the petitioner's grounds?
