Allahabad High Court

SMT. RAGINIversusRAJVEER SINGH

Decided

Holding

The High Court directed the Family Court to decide the matrimonial petition by 31 August 2026.

Summary

The petitioner, Smt. Ragini, filed a petition under Article 227 seeking expeditious disposal of her matrimonial petition (No. 628 of 2023) pending before the Family Court. The High Court had earlier, on 08‑05‑2024, directed speedy disposal but clarified that this did not bar adjudication of any other applications, including a Section 24 Hindu Marriage Act application decided on 03‑07‑2024. Despite issues being framed on 01‑08‑2024, the case remained delayed. The petitioner therefore moved this petition for a fresh direction. The Court observed the continued delay and, exercising its supervisory jurisdiction, ordered the Family Court to decide the matter on or before 31‑08‑2026, subject to filing a certified copy of the order within two weeks. The petition was consequently disposed.

Issues considered

  • Whether the High Court, under its supervisory jurisdiction under Article 227, can direct the Family Court to decide a pending matrimonial petition by a specific date.
  • Whether the earlier order for expeditious disposal precludes further applications under the Hindu Marriage Act, 1955.

                                                                                             .....Respondent(s)

                                    Counsel for Respondent(s)                       :

                                    Court No. - 5
                                                       HON'BLE KSHITIJ SHAILENDRA, J.

                                    1. Prayer for expeditious disposal of Matrimonial Petition No. 628 of
2023 (Smt. Ragini Vs. Rajveer Singh) has been made in this petition.

                                    2. Submission is that this Court had already directed for expeditious
disposal of the proceedings by order dated 08.05.2024 passed in Matters
Under Article 227 No. 5762 of 2024 (Smt. Ragini Vs. Rajveer Singh).

                                    3. A perusal of the said order indicates that though direction was issued,
however, it was made clear that the same would not preclude adjudication
of any other Misc. Case including an application under Section 24 of the
                                    Hindu Marriage Act, 1955.

                                    4. The order sheet indicates that the said application has also been decided
on 03.07.2024, whereafter issues have been framed on 01.08.2024 but the
proceedings thereafter are being delayed. It further appears that the matter
                                    is posted for final hearing.

                                    5. In view of the above, the petition is disposed of directing the
concerned Family Court to take up the matter and decide the same on or
before 31.08.2026, provided a certified copy of this order is filed before
the concerned court within two weeks from today.

                                                                                        (Kshitij Shailendra,J.)
                                    April 20, 2026
