Allahabad High Court

M/S KRISHNA UDYOGversusCENTRAL ORGANIZATION FOR RAILWAY ELECTRIFICATION

Decided

Holding

The High Court directed the executing court to proceed with Execution Case No. 59 of 2020 and decide it within three months, thereby granting the relief sought.

Summary

M/S Krishna Udyog filed a petition under Article 227 seeking a direction to the executing court to expedite Execution Case No. 59 of 2020 within three months, citing a similar order the High Court had earlier passed in Matter U/A 227 No. 2660/2026. The petitioner argued that the same relief should be granted. The Court, after hearing counsel Abhiuday Mehrotra, agreed to extend the same benefit and directed the executing court to decide the execution case within the stipulated period. The order was to be complied with upon production of a certified copy. The petition was thereafter disposed of.
