Allahabad High Court

YASH PANDEY @ DHIRENDRA AND 4 OTHERSversusState of UP AND ANOTHER

Decided

Holding

The High Court held that the trial court’s order was proper, not an abuse of process, and therefore the application for quashal was dismissed.

Summary

The petitioners Yash Pandey and others, who are accused in Complaint Case No.6433 of 2023 (Shivam Pandey v. Yash Pandey), filed an application under Section 482 of the Cr.P.C. seeking to quash the criminal proceedings for offences under Sections 352, 504 and 506 IPC. The complaint alleged that the petitioners, armed with lathi‑danda, attempted to take possession of land and assaulted the complainant, leading the trial court to record statements under Sections 200 and 202 Cr.P.C. and summon the petitioners for trial. The State opposed the petition, contending that the trial court had sufficient prosecutable evidence and had not abused its process. The High Court examined the material, found that the trial court’s order was based on a thorough examination of the complaint and evidence, and observed no abuse of process or error. Consequently, the Court dismissed the petition under Section 528 of the BNSS, holding that interference was unwarranted.

Issues considered

  • Whether the trial court’s order summoning the accused under Sections 352, 504 and 506 IPC constitutes an abuse of process warranting quash under Section 482 Cr.P.C.
  • Whether there is prosecutable evidence to justify the continuation of the criminal proceedings.
  • Whether the High Court can interfere with the trial court’s order in the present circumstances.
