Allahabad High Court
PIYUSH GUPTAversusSTATE OF U.P.
- Decided
Holding
The bail application was dismissed as infructuous because the applicant had already been acquitted.
Summary
The applicant, Piyush Gupta, filed a criminal miscellaneous bail application after the trial concluded and he was acquitted on 31 October 2025. Counsel argued that since the applicant had been acquitted, the bail application was no longer necessary and should be dismissed as infructuous. The State, represented by the Attorney General, raised no objection to this submission. The Court examined whether a bail application could remain viable post-acquittal and found that it could not, as the purpose of bail is to secure liberty pending trial or appeal, which was no longer applicable. Consequently, the bail application was dismissed as infructuous.
