Allahabad High Court
RAVENDRA PAL SINGHversusSTATE OF U.P.
- Decided
Holding
The applicant is entitled to be released on bail.
Summary
The applicant, Ravendra Pal Singh, was charged under Section 302 IPC for the death of his father‑in‑law. He claimed the death was accidental, caused by inhalation of an organophosphate insecticide, and that he was falsely implicated due to a property dispute. The FIR was lodged two years after the death, and the co‑accused had already been released on bail. Relying on the principles of parity, the lack of incriminating material, and the Supreme Court’s guidelines on bail in serious offences, the court granted bail, imposing standard conditions and verification requirements.
Issues considered
- Whether bail should be granted to an accused in a murder case (Section 302 IPC) where the accused claims innocence and alleges accidental death due to organophosphate poisoning.
- Whether the principle of parity and the fact that a co‑accused was released on bail justify granting bail to the applicant.
