Allahabad High Court

SHIVAM NAMDEVversusSTATE OF U.P.

Decided

Holding

The applicant is entitled to be released on bail.

Summary

Shivam Namdev applied for bail in a criminal case involving offences under Sections 103(1), 191(2), 191(3), 190, 109(1), 115(2) and 352 of the IPC. The applicant was not named in the FIR but was later implicated by an eye‑witness; no weapon was recovered from him and no specific role in the alleged homicide was established. The co‑accused had already been released on bail, and the applicant had no prior criminal record. The State opposed bail but did not dispute these facts. Relying on the Supreme Court’s guidelines in Kapil Wadhawan v. CBI, the Allahabad High Court, noting the nature of the offence, evidence, jail overcrowding and parity with co‑accused, granted bail with standard conditions.

Issues considered

  • Whether the applicant, who was not originally named in the FIR but later implicated, is entitled to bail.
  • Whether the nature of the offences and the evidence against the applicant justify denial of bail.
  • Whether parity with co‑accused already released on bail warrants granting bail to the applicant.
