Allahabad High Court
SALEEMversusSTATE OF U.P.
- Decided
Holding
The applicant is entitled to be released on bail.
Summary
The High Court considered a bail application filed by Saleem in Criminal Misc. Bail Application No. 14210 of 2026, seeking release in case No. 442 of 2025 under Sections 103(1), 238 and 3(5) of the B.N.S. Saleem was not named in the FIR but was mentioned in a confessional statement of the accused Rafeeq, with no incriminating material against him. The co‑accused Arshad and Arif had already been granted bail, and Saleem had no prior criminal record; a charge sheet had been filed, eliminating the need for custodial interrogation. The State opposed bail but did not dispute these facts. Relying on the principles of parity, the nature of the offence, overcrowded jails, and precedents such as Kapil Wadhawan v. CBI and Maya Tiwari v. State of U.P., the Court held that Saleem was entitled to bail, subject to standard conditions and verification of identity and sureties.
Issues considered
- Whether the applicant, who was not named in the FIR but mentioned in a confessional statement, is entitled to bail on the ground of parity with co‑accused already released.
- Whether the nature of the offence, lack of incriminating material, and the filing of a charge sheet justify granting bail.
- Whether the State's opposition, without disputing the factual matrix, is sufficient to deny bail.
