Allahabad High Court

UDAY @ KISHAN KUMARversusSTATE OF U.P.

Decided

Holding

The applicant is entitled to be released on bail.

Summary

The High Court considered a bail application filed by Uday @ Kishan Kumar in Criminal Misc. Bail Application No. 14615 of 2026, relating to Crime No. 874 of 2025 under IPC sections 103(1), 3(5), 61(2) BNS and Arms Act sections 3 and 25. The applicant argued that he was not named in the FIR and was only implicated later through an eye‑witness, claiming false implication and seeking parity with a co‑accused who had already been released on bail. The State opposed the bail but did not dispute the factual background. The Court, taking note of the nature of the offence, the filing of a charge‑sheet, the applicant’s clean record, jail overcrowding, and the guiding principles laid down in Kapil Wadhawan v CBI (2025), Maya Tiwari v State of U.P. (2024) and the Supreme Court’s bail policy (2021), decided that the applicant was entitled to bail without expressing an opinion on the merits. Accordingly, the Court ordered his release on bail subject to a personal bond, two sureties and standard conditions.

Issues considered

  • Whether the applicant, who was not originally named in the FIR and is alleged to have been falsely implicated, is entitled to bail under the applicable provisions of the IPC and Arms Act.
  • Whether the principle of parity with a co‑accused already released on bail warrants granting bail to the applicant.
