Allahabad High Court
AJAYversusSTATE OF U.P.
- Decided
Holding
The applicant is entitled to be released on bail subject to conditions.
Summary
The High Court considered a bail application filed by Ajay, accused in Criminal Case No. 751 of 2024 under Sections 103(1), 238(A) and 61(2)(A) of the B.N.S. The applicant argued that the prosecution’s witnesses only implicated co‑accused Rekha, Anjali and Shivani, and that he was falsely implicated as a family member with no prior criminal record. The State opposed bail but did not dispute the factual matrix. Relying on the Supreme Court’s guidelines in Kapil Wadhawan v. CBI (2025) and Maya Tiwari v. State of U.P. (2024), and considering jail overcrowding and case pendency, the Court granted bail without commenting on the merits. Ajay was ordered to be released on personal bond with two sureties and specific conditions, with provisions for verification and electronic transmission of the order.
Issues considered
- Whether the applicant, Ajay, is entitled to bail despite the serious nature of the offences alleged under the B.N.S.
- Whether the lack of direct eyewitness testimony against the applicant and his clean record justify bail under prevailing jurisprudence.

1. Heard Sri Ashutosh Kumar Pandey, learned counsel for the applicant,
Sri Anand Pratap Singh, learned A.G.A. for the State and perused the
record.
2. The instant bail application has been filed with a prayer to release the
applicant on bail in Case Crime No. 751 of 2024, under Sections- 103(1),
238(A), 61(2)(A) of B.N.S., Police Station- Tajganj, District- Agra,
during the pendency of the trial.
3. The contention of learned counsel for the applicant is that, as per the
prosecution story, the allegation of murdering the deceased by smothering
is against the co-accused, namely Rekha, Anjali and Shivani. The
allegation against the applicant is that he was also involved in the
aforesaid incident. However, the two eye-witnesses of the incident,
namely Abhishek and Devendra, have made specific allegations against
the co-accused Rekha, Anjali and Shivani, and no allegation has been
made against the applicant. It is further submitted that the applicant has
been falsely implicated in the present case, being a family member of the
co-accused Rekha, Anjali and Shivani. It is further submitted that the
applicant has no criminal history. It is further submitted that charge sheet
has been filed in the present case, therefore, there is no requirement of
custodial interrogation. The applicant is a law abiding citizen and he is
languishing in jail since 06.11.2024. In case, he is granted bail, he will not
misuse the liberty of bail and would cooperate in the trial proceedings.
