Allahabad High Court

MAHENDRA KUMAR GUPTAversusSTATE OF U.P.

Decided

Holding

The applicant is entitled to be released on bail.

Summary

Mahendra Kumar Gupta was arrested in connection with a murder case (Crime No. 18 of 2026) where the deceased was allegedly struck with a wheel spanner by co‑accused Ravi Kiran Nishad. The applicant contended that he merely brought his son to the Primary Health Centre and that no incriminating material linked him to the assault, citing a medical officer’s report and the fact that another co‑accused, Akash Kumar, had already been released on bail. The State opposed bail but could not dispute the parity between the applicant and the co‑accused already on bail. Relying on the Supreme Court’s guidelines in Kapil Wadhawan v. CBI (2025) and the policy on bail (In Re: Suo Motu Writ Petition No. 4 of 2021), the High Court held that the applicant was entitled to bail. Accordingly, the bail application was allowed subject to standard conditions and verification of sureties.

Issues considered

  • Whether the applicant, Mahendra Kumar Gupta, is entitled to bail under Section 103(1) of the Code of Criminal Procedure in a non‑bailable murder case.
  • Whether parity with a co‑accused already released on bail warrants granting bail to the applicant.
