Allahabad High Court
DEVENDRA SINGHversusSTATE OF U.P.
- Decided
Holding
The applicant is entitled to be released on bail.
Summary
The Allahabad High Court considered a bail application filed by Devendra Singh, who was charged under Sections 302 and 120B of the IPC for a murder that allegedly occurred on 09.04.2023, with the FIR lodged a year later under Section 156(3) of the CrPC. The applicant claimed innocence, lack of eyewitness testimony, and highlighted that a co‑accused with an identical role had already been released on bail, arguing parity. The State opposed bail but did not dispute the factual contentions. Relying on the Supreme Court decisions in Kapil Wadhawan v. CBI (2025), Maya Tiwari v. State of U.P. (2024), and the policy directive in the Suo Motu Writ Petition on bail (2023), as well as concerns of jail overcrowding, the Court granted bail without commenting on the merits, imposing standard conditions. The order directed verification of identities, electronic transmission of the bail order, and compliance with procedural safeguards.
Issues considered
- Whether bail should be granted to an accused in a murder case (IPC 302, 120B) during trial despite serious charges.
- Whether the delayed filing of the FIR and lack of eyewitness evidence justify bail.
- Whether parity with a co‑accused already released on bail warrants granting bail to the applicant.
- How Supreme Court precedents on bail and considerations of jail overcrowding influence the decision.
