Allahabad High Court

HARSH RAIversusSTATE OF U.P.

Decided

Holding

The Court granted bail to Harsh Rai, finding that the circumstances warranted release on personal bond with conditions.

Summary

Harsh Rai was arrested in connection with a case (Crime No. 17 of 2026) alleging assault with a sharp‑edged weapon (tangari) under Sections 191(3), 109(1), 352 and 351(3) of the B.N.S. The victim, Sanjeev Rai, sustained two incised wounds and a contused swelling, none of which were life‑threatening. The applicant, who has three pending criminal cases but no convictions, has been in jail since 28 January 2026. The State opposed bail, while the applicant’s counsel highlighted that co‑accused Alok Rai, Laxmina Rai and Adarsh Giri had already been granted bail in similar circumstances. The Court, noting the non‑dangerous nature of the injuries, the applicant’s similar footing to the co‑accused, and the absence of any indication of flight or evidence tampering, found a prima facie case for bail and ordered his release on personal bond with two sureties and standard conditions. The order also directed electronic transmission of the bail order to the jail for prompt release.

Issues considered

  • Whether Harsh Rai is entitled to bail despite the alleged assault with a sharp‑edged weapon.
  • Whether the nature of the injuries and the applicant’s criminal history justify denial of bail.
  • Whether the grant of bail to co‑accused in similar circumstances mandates similar relief to the applicant.
