Allahabad High Court

JAINULversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to be released on bail.

Summary

The Allahabad High Court considered a bail application filed by Jainul in Criminal Misc. Bail Application No. 16734 of 2026, relating to Crime No. 442 of 2025 under Sections 103(1), 238 of the Indian Penal Code and 3(5) of the B.N.S. The applicant was not named in the FIR but was mentioned as an accomplice in a confessional statement of a co-accused, with the only material seized being a scarf belonging to him. The counsel argued that a co-accused in an identical role had already been released on bail, that the applicant had no prior criminal record, and that a charge sheet had been filed, removing the need for custodial interrogation. The State opposed bail but did not dispute these facts. Relying on the principle of parity, the lack of incriminating evidence, the presence of a charge sheet, and the Supreme Court’s guidelines in Kapil Wadhawan and Maya Tiwari, the court granted bail with standard conditions.

Issues considered

  • Whether bail should be granted to an accused not named in the FIR but implicated in a confessional statement.
  • Whether the release of a similarly situated co-accused on bail creates a right to bail for the applicant.
  • Whether the filing of a charge sheet obviates the necessity for custodial interrogation.
  • Whether overcrowding of prisons and pendency of cases justify bail in this circumstance.
