Allahabad High Court

SADIQversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The bail application was dismissed as infructuous because the applicant had already been convicted.

Summary

The applicant, Sadiq, filed a bail application (Criminal Misc. Bail Application No. 19006 of 2025) before the Allahabad High Court after being convicted on 25 May 2026. Counsel for the applicant argued that since the trial had concluded and a conviction was recorded, the bail application was no longer viable and should be dismissed as infructuous. The opposing side, represented by the Additional Government Advocate, raised no objection to this submission. The Court, after noting the lack of any objection and the fact that the conviction rendered the bail petition moot, dismissed the bail application as infructuous. No substantive discussion on legal principles was required, and the order was pronounced on 18 September 2026.
