Allahabad High Court

PRADEEP KUMARversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The applicant is entitled to bail.

Summary

The High Court considered a bail application filed by Pradeep Kumar, who was charged under CrPC Section 65(1), IPC Sections 351(3) and 352, and POCSO Sections 3 and 4(2) for allegedly attempting indecent assault on a minor. The applicant argued that the victim’s statements recorded under Sections 180 and 183 of the Evidence Act were contradictory, there was no medical evidence of injury, and he had no prior criminal record. The State opposed bail but did not dispute the factual matrix. After evaluating the contradictions in the victim’s statements, the lack of forensic evidence, and the nature of the alleged offence, the Court held that the applicant was entitled to bail. Accordingly, the bail was granted subject to a personal bond, sureties and specific conditions, with directions for electronic release procedures.

Issues considered

  • Whether the applicant is entitled to bail under CrPC Section 65(1) given the nature of the offences under IPC 351, 352 and POCSO Sections 3, 4(2).
  • Whether contradictions in the victim’s statements and absence of medical evidence justify granting bail.

further submitted that there is serious contradiction in the statement of the

rape or attempt to rape. Even, the medical examination report of the victim
