Allahabad High Court

NAKULversusSTATE OF U.P.

Decided

Holding

The Court held that the applicant is entitled to be released on bail.

Summary

The applicant, Nakul, was arrested in connection with a murder despite not being named in the FIR, based on his alleged presence near the deceased's body and a message sent from his sister's phone. The co‑accused, Aniket, confessed to the strangulation, while other co‑accused have already been released on bail, prompting a claim of parity for Nakul. The applicant argued he has no criminal record, the charge sheet is already filed, and there is no need for custodial interrogation. The State opposed bail but did not dispute the factual background. Relying on Supreme Court precedents and the need to decongest jails, the Court granted bail on condition of a personal bond, sureties, and compliance with stipulated conditions.

Issues considered

  • Whether the applicant, who was not named in the FIR but was arrested based on alleged involvement, is entitled to bail under the CrPC provisions.
  • Whether parity with co‑accused already released on bail warrants granting bail to the applicant.
  • Whether the presence of a charge sheet and the applicant's clean record justify bail despite the seriousness of the offence.

3. Contention of learned counsel for the applicant is that applicant
was not named in the FIR. Subsequently, the applicant and co-

dead body of the deceased. It is further submitted that in the
confessional statement of the co-accused, Aniket, he admitted to
strangulate the deceased and the role assigned to the applicant and
other co-accused persons to catch hold of the deceased. It is further
submitted that applicant has been falsely implicated in this case only
on the basis that applicant has sent a message for ransom from his
sister's mobile phone but the role of strangulation has been
specifically assigned to the co-accused, Aniket. It is further submitted
that the co-accused, Aniket, Anmol, Akash and Umesh, have already
