Allahabad High Court
ASHISH KUMARversusSTATE OF U.P. AND 3 OTHERS
- Decided
Holding
The applicant is entitled to be released on bail.
Summary
The High Court of Allahabad considered a bail application filed by Ashish Kumar in Criminal Case No. 27 of 2025, which involved charges under Sections 137(2), 87 and 65(1) of the Bharatiya Nyaya Sanhita, 2023 and Sections 5(1) and 6 of the Protection of Children from Sexual Offences Act, 2012. The applicant argued that the FIR was based on the alleged disappearance of the victim, but the victim’s statement recorded under Sections 180 and 183 of the BNSS indicated that she voluntarily left the house with the applicant and no offence was committed. The applicant had no prior criminal record and the charge‑sheet had already been filed, so custodial interrogation was deemed unnecessary. The State opposed bail but did not dispute the factual matrix presented. After evaluating the victim’s statement, the nature of the alleged offence, and the lack of any indication of flight risk or tampering, the Court held that the applicant was entitled to bail. Accordingly, the bail application was allowed subject to a personal bond, two sureties and specific conditions. The order also directed electronic transmission of the bail order to the jail and trial court in compliance with Supreme Court policy on bail procedures.
