Allahabad High Court
CHHAVI NATHversusSTATE OF U.P.
- Decided
Holding
The applicant is entitled to bail and the bail application is allowed.
Summary
The High Court considered a bail application filed by Chhavi Nath, who is accused in Crime No. 228 of 2022 for offences under IPC sections 147, 148, 149, 325, 323, 504, 506 and 304, including murder. The prosecution alleges that the accused and co‑accused attacked the deceased and other persons, resulting in one death and several injuries. The defence highlighted that the injured witnesses turned hostile, claimed the incident was a sudden quarrel, and could not identify the person who caused the fatal injury, while also noting the applicant's clean record and lack of custodial interrogation need. The State opposed bail but did not dispute the factual matrix. Weighing the nature of the offences, the hostile witness testimony, and the applicant's circumstances, the Court held that bail should be granted with standard conditions, and ordered his release on personal bond and sureties.
Issues considered
- Whether bail can be granted in a case involving serious offences including murder when key witnesses are hostile and the prosecution lacks conclusive material against the accused.
