Allahabad High Court
ANITA CHAUHANversusSTATE OF U.P.
- Decided
Holding
The court held that Anita Chauhan is entitled to be released on bail.
Summary
Anita Chauhan applied for bail in a criminal case (Crime No.310 of 2025) alleging false implication and lack of substantive evidence, including no weapon assignment. The FIR and statements only contain general allegations of beating the first informant. The applicant, a first‑time female offender, argued that the charge sheet had already been filed and she would not misuse bail. The State opposed bail, but the court, considering the applicant's gender, the nature of the offences, jail overcrowding, and recent Supreme Court precedents, granted bail without commenting on the merits. Bail was ordered on personal bond with two sureties and specific conditions, with provisions for electronic release and verification.
Issues considered
- Whether bail should be granted to Anita Chauhan pending trial despite the seriousness of the offences charged.
- Whether the applicant's gender, lack of prior criminal record, and jail overcrowding justify bail under prevailing Supreme Court jurisprudence.
