Allahabad High Court
SHRIMATI DEVIversusSTATE OF U.P.
- Decided
Holding
The applicant is entitled to be released on bail.
Summary
Shrimati Devi was arrested in connection with Crime No.310 of 2025, alleged under IPC sections 3(5), 109, 110, 115(2), 131, 333 and 352. She filed a bail application claiming she was falsely implicated, that the FIR and statements contain only vague allegations, no weapon was assigned to her, and she has no prior criminal record. The State opposed bail, but the court considered the nature of the offence, the applicant’s gender, the lack of concrete evidence, jail overcrowding and the Supreme Court’s recent pronouncements in Kapil Wadhawan v. CBI and the 2023 bail policy judgment. Relying on these factors, the court held that the applicant is entitled to bail pending trial. Accordingly, bail was granted subject to a personal bond, two sureties and conditions restricting tampering with evidence, inducement of witnesses, and further criminal activity. The order also directed electronic transmission of the bail order to ensure prompt release.
Issues considered
- Whether the applicant, Shrimati Devi, is entitled to bail pending trial for offences under IPC sections 3(5), 109, 110, 115(2), 131, 333 and 352.
- Whether the alleged lack of specific evidence, the applicant’s gender, and jail overcrowding justify granting bail despite the seriousness of the charges.
