Allahabad High Court

SAMEERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court allowed the bail application, finding that the applicant had made out a case for bail.

Summary

The High Court considered a bail application filed by Sameer, who is charged under Sections 363 and 376 of the Indian Penal Code and Sections 3 and 4 of the POCSO Act for an alleged offence involving a victim. The applicant’s counsel argued that the victim is a major, consented to the encounter, and has not supported the prosecution’s version, citing statements under Sections 180 and 183 of the B.N.S.S. and the victim’s refusal to undergo a medical examination. The State opposed bail, contending that innocence cannot be determined at the pre‑trial stage and that the applicant might misuse liberty. After weighing the submissions, the court found that the applicant had made out a case for bail without expressing an opinion on the merits. Consequently, the bail was granted subject to personal bond, sureties and several conditions, with a warning that breach would lead to cancellation.

Issues considered

  • Whether bail should be granted to the accused at the pre‑trial stage despite serious charges under IPC and POCSO.
  • Whether the victim's alleged consent and refusal to undergo medical examination negate the existence of an offence.
