Allahabad High Court

SHOAIB ALIAS SONUversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to bail despite the gravity of the charge, as he was not directly responsible for the murder and meets the criteria laid down in recent Supreme Court bail precedents.

Summary

The applicant, Shoaib alias Sonu, was arrested in connection with a murder alleged to have arisen from a salary dispute. The FIR broadly implicated all accused, but CCTV footage showed that the applicant only had a brief scuffle with the deceased, after which co‑accused Shahnawaz attacked the victim with a danda, leading to death. The applicant has no prior criminal record and has been in custody since 30‑05‑2025. The State opposed bail but did not dispute the factual matrix. Relying on the nature of the applicant’s limited involvement, the Supreme Court’s bail jurisprudence (Kapil Wadhawan vs CBI, Maya Tiwari vs State UP, and the Policy Strategy for Grant of Bail judgment) and concerns of jail overcrowding, the High Court granted bail with standard conditions.

Issues considered

  • Whether bail can be granted to an accused in a murder case under Section 103(1) CrPC when his participation is limited to a minor scuffle.
  • Whether the applicant’s lack of prior criminal record and the presence of CCTV evidence justify bail despite the seriousness of the offence.
  • How the Supreme Court’s recent bail guidelines (Kapil Wadhawan vs CBI, Maya Tiwari vs State UP, Policy Strategy for Grant of Bail) apply to this case.

during the trial in Case Crime No. 101 of 2025, under Section 103(1), 352 B.N.S., P.S.
Jajmau, District Kanpur Nagar.

3. Contention of learned counsel for the applicant is that in the FIR, general allegation
has been made against all the accused persons for beating the deceased over the
dispute of salary of the deceased which was due against co-accused Fahran. Learned
counsel for the applicant further submitted that CCTV installed outside the place of
incident in question shows that over petty issue, there was scuffling between the
applicant and deceased thereafter the co-accused Shahnawaz reached on the spot and
started beating the deceased with Danda and thereafter left the place of incident with
Scorpio. It is further submitted that on the pointing out of co-accused Shahnawaz, a
danda was also recovered, therefore, there is specific allegation against co-accused
Shahnawaz for beating the deceased with danda which resulted in his death. There is
no role assigned to the applicant for causing murder of the deceased as prior to the
incident applicant and deceased had scuffled on petty issue. It is lastly submitted that
charge sheet has been filed by the police, therefore, there is no requirement for
custodial interrogation. The applicant has no criminal history and he is languishing in
