Allahabad High Court

ALMUDDINversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court held that the applicant is entitled to be released on bail.

Summary

The Allahabad High Court considered a bail application filed by Almuddin, accused in Crime No. 386 of 2024 under Section 103(1) of the BNS for allegedly running over a deceased with a tractor. The applicant argued that the death was accidental, that key eyewitnesses did not support the prosecution, and that there was no material against him, emphasizing his law‑abiding character and the need to avoid jail overcrowding. The State opposed bail but did not dispute the factual matrix. Relying on Supreme Court precedents in Kapil Wadhawan v. CBI, Maya Tiwari v. State of U.P., and the policy directive on bail, the court, without expressing a view on the merits, granted bail with strict conditions and procedural safeguards. The order directed verification of identities, issuance of a computer‑generated bail order, and prompt release through the Bail Order Management System.

Issues considered

  • Whether bail should be granted to the accused under Section 103(1) of the BNS in view of the alleged accidental nature of the death and the evidentiary record.
  • Whether the Supreme Court guidelines on bail, jail overcrowding, and pendency of cases warrant the release of the applicant.
  • Whether the conditions imposed are sufficient to safeguard the trial and prevent tampering with evidence.
