Holding
The bail application is allowed; the accused is to be released on bail subject to conditions.
Summary
The High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of Manjeet Nishad, who was arrested in a case under the Uttar Pradesh Gangsters and Anti‑Social Activities (Prevention) Act, 1986 (Crime No. 618 of 2025). The applicant pleaded innocence, asserted that he was not a gang member or organizer, and argued there was no risk of flight or witness tampering. The State opposed the bail but did not present any additional incriminating material beyond the charges. After reviewing the record and invoking Section 19(4) of the Gangsters Act, the Court, without commenting on the merits, found the circumstances suitable for bail. Consequently, the Court ordered the applicant’s release on bail subject to a personal bond, two sureties and specific conditions to prevent interference with witnesses or evidence.
Issues considered
- Whether bail should be granted to the accused under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in a case instituted under the Uttar Pradesh Gangsters and Anti‑Social Activities (Prevention) Act, 1986.
