Allahabad High Court

JYOTI @ SONIversusSTATE OF U.P.

Decided

Holding

The applicant is entitled to bail and the bail application is allowed.

Summary

The High Court considered a bail application filed by Jyoti @ Soni, accused in Crime No.215 of 2025 under Section 103(1) BNS for allegedly assaulting a deceased with a gaita. The prosecution’s evidence was weakened by the police’s failure to produce the forensic‑science‑lab report, colour photographs, and video footage of the weapon recovery, and the court noted negligence by the investigating officer. The applicant argued that the incident arose from a quarrel, there were no eye‑witnesses, she has no criminal record, and she is a woman, warranting bail under Section 480 BNSS. The State opposed bail but did not dispute the factual background. Relying on Supreme Court precedent (Kapil Wadhawan v. CBI, 2025) and the Court’s own guidelines (Maya Tiwari v. State of U.P., 2024) as well as policy directives on bail, the judge granted bail with conditions. The order also directed compliance with videography requirements under Section 105 BNSS and procedural steps for release.

Issues considered

  • What is the appropriate exercise of discretion in granting bail to an accused under Section 103(1) BNS when police evidence is incomplete?
  • Does the applicant’s gender, lack of prior criminal record, and the nature of the alleged offence justify bail under Section 480 BNSS?
  • How does the failure to produce the FSL report and video footage affect the bail decision?
