Allahabad High Court

AMAN NAGPALversusNAMAN JAIN AND ANOTHER

Decided

Holding

A civil revision may be dismissed as withdrawn when the petitioner expressly withdraws the application, subject to liberty to file a fresh revision.

Summary

The petitioners (revisionists) filed a civil revision (No. 86 of 2026) before the Allahabad High Court challenging an earlier order. During the hearing, counsel for the revisionists informed the court that they no longer wished to pursue the revision and sought to withdraw it. The court considered the counsel's request and, noting the absence of any objection from the respondents, allowed the withdrawal. Consequently, the revision was dismissed as withdrawn, with liberty granted to the petitioners to file a fresh revision if they so desire. The court also ordered that the certified copy of the relevant documents be returned to the petitioners' counsel, while retaining a photostat copy on record.
