Allahabad High Court

ASHUTOSH SHANKER SINGHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The court declined to quash the FIR and permitted the petitioner to seek anticipatory bail and other legal remedies, disposing the writ petition.

Summary

The petitioner, Ashutosh Shanker Singh, filed a criminal miscellaneous writ petition seeking the quashing of an FIR. During the hearing, the petitioner, through senior counsel I.K. Chaturvedi and counsel Navneet Pandey, indicated that he no longer wished to pursue the quashing of the FIR. Consequently, the court declined the relief for quashing the FIR. The petitioner then recast his relief, requesting leave to approach the appropriate court for anticipatory bail and any other legal remedies available. Respondent No.3, represented by Manvendra Kumar, raised no objection to this revised prayer. The High Court disposed of the writ petition, leaving the petitioner free to seek anticipatory bail and other remedies in the competent forum. The order was pronounced by Judges Ajay Bhanot and Divesh Chandra Samant on 17 September 2026.
