Allahabad High Court
PUSHPENDRA SINGHversusSTATE OF U.P. AND 4 OTHERS
- Decided
Holding
The Court directed the Superintendent of Police to ensure a fair and impartial investigation in the specified cases.
Summary
Petitioner Pushpendra Singh filed a criminal miscellaneous writ petition seeking a court direction that the police conduct a fair and impartial investigation in four pending criminal cases registered at Police Station Dholna, Kasganj. The petitioner alleged that the investigations were not being conducted impartially. The High Court examined whether it could issue such a direction under the law. The Court held that it could direct the Superintendent of Police to ensure a fair investigation and provided a mechanism for the petitioner to raise grievances. Accordingly, the Court ordered the SP to conduct a fair investigation, allowed the petitioner to file an application with the SP if any grievance arose, and disposed of the writ petition with those directions.
