Allahabad High Court

SMT GEETA SINGHversusSTATE OF U.P. AND 8 OTHERS

Decided

Holding

The Court may direct the Superintendent of Police to ensure a fair and impartial investigation and to consider any grievance filed by the petitioner.

Summary

The petitioner, Smt. Geeta Singh, filed a criminal miscellaneous writ petition under Article 226 seeking a direction that the police conduct a fair and impartial investigation into a case (Crime No. 547 of 2025) involving alleged offences under Sections 419, 420, 467, 468 and 471 of the Indian Penal Code. The High Court examined whether it could issue such a direction to the Superintendent of Police to ensure a proper investigation. The Court held that it could, and issued specific directions mandating the Superintendent to conduct a fair inquiry and to entertain any grievance the petitioner may have. The directions also required the Superintendent to examine any grievance in accordance with law. The writ petition was thereafter disposed after the directions were granted.

Issues considered

  • Whether the High Court can, under its writ jurisdiction, direct the police to conduct a fair and impartial investigation in a criminal case.
  • Whether the petitioner is entitled to a statutory remedy for alleged bias or unfairness in the investigation.
