Allahabad High Court

ASHOK KUMAR SINGH AND ANOTHERversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The case is to be re‑listed for fresh hearing after proper service of notice to Respondent No.4.

Summary

Petitioners Ashok Kumar Singh and another filed a criminal miscellaneous writ petition before the Allahabad High Court. The matter was heard by a Division Bench comprising Justices Rajeev Misra and Lakshmi Kant Shukla, and a detailed judgment was initially dictated. However, the Court later discovered that notice had not been served on Respondent No.4 as required by procedural law. Consequently, the Bench adjourned the case and directed that the necessary steps be taken to serve the notice. The matter has been ordered to be listed afresh before the same Bench on 27‑04‑2026, subject to obtaining the required nomination orders from the Chief Justice.

                                    Court No. - 47
                                                        HON'BLE J.J. MUNIR, J.

This matter was apparently heard at length by a Division Bench
comprising Hon'ble Mr. Justice Rajeev Misra and Hon'ble Mr. Justice
Lakshmi Kant Shukla and a detailed judgment was dictated. However,
later on, on account of a procedural requirement of service of notice on
respondent no.4, this matter was adjourned with a direction to take steps.

We are of the opinion that this matter be laid before the same Bench as
fresh, if possible, on 27.04.2026 after seeking necessary orders of
nomination from His Lordship the Hon'ble Chief Justice.

                                                                          (Tarun Saxena,J.) (J.J. Munir,J.)
