Allahabad High Court

SURESH SHARMAversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The revision petition is dismissed for want of prosecution due to the petitioner's failure to appear.

Summary

The revision petition filed by Suresh Sharma against the State of U.P. and others was scheduled for admission, but the petitioner failed to appear on the appointed dates of 10-02-2026 and 09-04-2026, and again on the hearing day. The opposite party counsel highlighted the petitioner's consistent non-appearance and lack of prosecution. The court noted that the revisionist had not engaged the proceedings despite adjournments being granted at their request. Consequently, the court held that the revision could not proceed without prosecution. The revision was therefore dismissed for want of prosecution.

Counsel for Revisionist(s) : Amit Kumar Pandey, Pradeep Kumar
                                                                    Soni
Counsel for Opposite Party(s) : G.A., Suneel Kumar

                                    Court No. - 88
                                                         HON'BLE ACHAL SACHDEV, J.

                                    1. Sri Suneel Kumar, learned counsel for the opposite party nos.2 to 4 and
learned AGA for the State are present.

                                    2. None appears to press this revision on behalf of the revisionist, even in the
                                    revised call.

                                    3. Learned counsel for the opposite party nos.2 to 4 states that revisionist has
failed to appear before the court consistently.

                                    4. Perusal of order sheet shows that the date is fixed in the present revision
for admission, since the revisionist did not appear on 10.02.2026 and on
09.04.2026 the case is adjourned on the request of counsel for the revisionist
and today also none appeared on behalf of the revisionist, which shows that
the revisionist is not inclined to contest the revision.

                                    5. In the aforesaid circumstances, present revision is dismissed for want of
                                    prosecution.
