Allahabad High Court

GULAB USMANIversusSTATE OF U.P.

Decided

Holding

The court ordered the release of the applicant on a personal bond of Rs. 1,00,000 and two sureties of equal amount in all the pending cases.

Summary

The applicant, Gulab Usmani, filed an application under Section 528 of the B.N.S.S. seeking release from custody in eight criminal cases where bail had been granted but he could not furnish the required sureties. He contended that the cases were based on confessional statements, which he argued were inadmissible and that the police lacked authority to record such statements. The applicant, described as a poor person, had been in jail since 28 January 2025, with his last bail application allowed on 27 February 2026. The court examined the statutory provision allowing release on personal bond and considered the applicant's inability to provide sureties. It directed that the applicant be released in all the listed cases upon furnishing a personal bond of Rs. 1,00,000 and two sureties of the same amount, satisfying the concerned courts. The application was consequently disposed of.

Issues considered
