The High Court held that a verified compromise in a matrimonial dispute warrants quashing the criminal proceedings even when the offence is cognizable and non‑compoundable.
Summary
The applicants, Avnish Yadav and another, filed an application under Section 528 of the B.N.S.S. seeking to quash criminal proceedings (Criminal Case No. 6448 of 2024) initiated under Section 6 of the Dowry Prohibition Act, arising from a matrimonial dispute with Khushbu Yadav. The parties had reached a compromise on 6 March 2026, which was verified by the trial court and reported to the High Court. Both counsel and the Additional Government Advocate submitted that the dispute was settled and continuation of prosecution would serve no useful purpose. Citing Supreme Court precedents allowing compromise even in cognizable, non‑compoundable offences, the High Court held that the compromise justified quashing the proceedings. Consequently, the summoning order dated 18 May 2024 and the entire criminal case were quashed, and the application was allowed.
