The court held that the applicant should be released in all seven cases on a personal bond of Rs.1,00,000 and two sureties of equal amount, given his inability to furnish sureties and the circumstances of his detention.
Summary
The applicant, Aniruddh Alias Raja Alias Mama, filed an application under Section 528 of the B.N.S.S. seeking release in seven pending criminal cases on the basis of a personal bond and two sureties. He argued that he is a poor person unable to furnish the required sureties and that his arrest in an Arms Act case was based on an irrelevant confessional statement. The court noted that bail had been granted in all the cases but the applicant remained incarcerated since 18‑09‑2025. Considering his financial incapacity, the court directed that he be released in all seven cases upon furnishing a personal bond of Rs.1,00,000 and two sureties of the same amount. The application was disposed of finally with the said directions.
Issues considered
- Whether the applicant can be released on personal bond and two sureties under Section 528 of the B.N.S.S. despite multiple pending cases
