Allahabad High Court

REEMA MAURYAversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The High Court ordered the trial court to decide the pending case within six months and disposed of the application without notice to the other parties.

Summary

The applicant, Reema Maurya, filed an application under Section 529 of the Code of Civil Procedure seeking an expeditious disposal of her pending complaint (Case No. 44893 of 2022) filed under Section 12 of the Domestic Violence Act. The matter, originating in 2022, had not yet reached a conclusion in the Additional Civil Judge's court in Gorakhpur. The State's counsel raised no objection to an expedited hearing. The High Court directed the trial court to endeavour to decide the case within six months of the order, barring any legal impediment and without unnecessary adjournments. The application was disposed of without issuing notice to the other parties, noting it as an innocuous order, and the parties were informed they could approach the High Court if aggrieved.

Issues considered

  • Whether the High Court can direct the trial court to dispose of a pending civil suit expeditiously under Section 529 CPC.
  • Whether notice to the other parties is required for such an order.
