Allahabad High Court

QAADIR AND 8 OTHERSversusSTATE OF U.P.

Decided

Holding

The court directed the trial court to decide the case expeditiously, preferably within one year, and to refrain from undue adjournments.

Summary

The applicants filed an application under Section 529 of the Criminal Procedure Code seeking an expedited trial in Sessions Case No. 2297 of 2024, which involved offences under Sections 147, 148, 323, 325 and 506 IPC. The trial had been pending for a long period without reaching a conclusion. The State, represented by the Advocate General, raised no objection to expediting the case. The High Court, noting the undue delay, directed the trial court to complete the trial within one year of the certified copy of the order, provided there are no legal impediments, and to avoid unnecessary adjournments. The application was thereafter disposed of.
