Allahabad High Court

DEEPIKA RAOversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The High Court held that it may order the trial court to decide the case expeditiously, preferably within one year, subject to the absence of legal impediments.

Summary

The applicant, Deepika Rao, filed an application under Section 529 of the Criminal Procedure Code seeking an expeditious disposal of a pending criminal trial (S.T. No. 439 of 2025) involving offences under Sections 376, 328, 504 and 506 IPC. The trial court had been hearing the case since 2025 with no conclusion. The State's Additional Government Advocate agreed that issuing notice to other parties was unnecessary and had no objection to expediting the matter. The High Court, after hearing counsel, directed the trial court to decide the case within one year of the order, provided there is no legal impediment and without unnecessary adjournments. The application was consequently disposed.
