Holding
The High Court may order the trial court to dispose of the pending complaint expeditiously, preferably within one year, and may dispose of the application without mandating notice to other parties.
Summary
The applicant Bhanu Priya Dubey filed an application under Section 529 of the B.N.S.S. seeking an expeditious disposal of Complaint Case No. 275 of 2025 pending before the Additional Civil Judge, Deoria. The applicant argued that the case, filed in 2025, had not yet reached a conclusion. The State, represented by the Advocate General, did not oppose expediting the matter and saw no need to issue notice to the other respondents. The High Court, after hearing counsel, directed the trial court to endeavour to decide the case within one year of the certified copy of the order, without unnecessary adjournments. No further directions were made and the application was disposed of.
Issues considered
- Whether the High Court can direct a trial court to decide a pending criminal complaint within a specified time frame under Section 529 B.N.S.S.
- Whether notice to additional opposite parties is required in an application for expeditious disposal.
