Allahabad High Court

VIMLESHversusSTATE OF U.P. AND 4 OTHERS

Decided

Holding

The court held that the applicant is exempted from producing another copy of Annexure No.3 and that the trial court must endeavor to dispose of the pending criminal case expeditiously within six months, provided there are no legal impediments.

Summary

The applicant filed an exemption application under Section 529 of the Criminal Procedure Code seeking relief from producing another copy of Annexure No.3, which the State’s Additional Government Advocate did not oppose. The court found the grounds sufficient and granted the exemption. The applicant also moved the court to direct the Judicial Magistrate of Chhata, Mathura, to expedite the pending criminal trial (Case No. 955 of 2018, involving offences under Sections 354B, 452, 324 and 506 IPC) within six months, citing undue delay. The State’s counsel had no objection to expediting the matter. The court ordered the trial court to make all efforts to dispose of the case within six months of the certified copy of the order, barring any legal hurdles and without unnecessary adjournments. Both applications were disposed of by the court.

Issues considered

  • Whether the applicant can be exempted from producing another copy of Annexure No.3 under Section 529 CrPC.
