Allahabad High Court

RITESH YADAVversusSTATE OF U.P.

Decided

Holding

The court held that the trial court must endeavor to dispose of the case within six months, subject to the absence of any legal hurdle.

Summary

Ritesh Yadav, the applicant, is facing a pending criminal trial (Session Case No. 643 of 2025) arising from offences under Sections 392, 411, 414 and 120‑B IPC. He was selected for a post in the Indian Army and later for a clerkship in the Chandigarh High Court, but adverse police verification reports linked to the pending case prevented his appointment. He filed an application under Section 529 of the Criminal Procedure Code seeking expeditious disposal of the trial. The State’s Additional Government Advocate raised no objection to the request. The Hon’ble Judge directed the trial court to make every effort to decide the case within six months of the certified copy of the order, provided there is no legal hurdle. The application was disposed with this directive.

Issues considered

  • Whether the pending criminal case should be expedited under Section 529 CrPC?
