Allahabad High Court

KARMVEER SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court ordered the trial court to decide the pending case expeditiously, preferably within six months, and disposed of the application.

Summary

The applicant, Karmveer Singh, filed an application under Section 529 of the Criminal Procedure Code seeking an expeditious disposal of a pending complaint (Case No. 16186 of 2023) filed under Section 138 of the Negotiable Instruments Act. The complaint, titled Karmveer Vs. Sanjay, had been pending before the Additional Chief Judicial Magistrate‑II, Gautambuddha Nagar, for an extended period without reaching a conclusion. The applicant argued that the delay was unjustified, while the State (represented by the A.G.A.) raised no objection to an expedited hearing. The Court, after hearing counsel, directed the trial court to endeavour to decide the matter within six months of the order, provided there were no legal impediments, and to avoid unnecessary adjournments. Consequently, the application was disposed of with the direction for speedy disposal of the pending case.

Issues considered

  • Whether the trial court can be directed under Section 529 CrPC to dispose of a pending criminal case expeditiously.
  • Whether a specific time‑frame (six months) can be imposed on the trial court for deciding a case under Section 138 NI Act.
