Allahabad High Court

SWAPNENDRA SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court ordered the trial court to decide the pending criminal case within six months, subject to the absence of any legal impediment, and disposed of the application.

Summary

The applicant, Swapnendra Singh, filed an application under Section 529 of the Criminal Procedure Code seeking expeditious disposal of a pending criminal trial (Sessions Case No. 615 of 2022) involving offences under Sections 323, 504, 506, 364 and 392 of the Indian Penal Code. The applicant argued that the case had been pending for an unduly long period without reaching a logical conclusion. The State, represented by the Additional Government Advocate, raised no objection to the applicant’s request. The High Court, after hearing counsel, directed the trial court to endeavour to conclude the case within six months of the order, provided there is no legal impediment, and to avoid unnecessary adjournments. The application was consequently disposed of with the said direction.

Issues considered

  • Whether the High Court can order expeditious disposal of a pending criminal trial under Section 529 CrPC
  • Whether any legal impediment exists that would prevent the trial court from concluding the case within six months
