Allahabad High Court

MANDEEP SINGHversusSTATE OF U.P. AND 2 OTHERS

Decided

Holding

The High Court directed the trial court to decide the pending application within two months and disposed of the Section 529 application.

Summary

The applicant, Mandeep Singh, filed an application under Section 529 of the Criminal Procedure Code seeking expeditious disposal of his pending application dated 06.01.2026 for the release/de‑freezing of a bank account frozen in connection with criminal cases under the Bharatiya Nyaya Sanhita, 2023 and the Indian Penal Code. The applicant argued that the trial court had not decided the application despite the lapse of time. The State, represented by the Additional Government Advocate, raised no objection to the applicant’s request. The High Court, after hearing counsel, directed the trial court to decide the pending application within two months, provided there is no legal impediment, and to avoid unnecessary adjournments. The application under Section 529 was consequently disposed of.

Issues considered

  • Whether the High Court should direct the trial court to decide the pending application for release of the frozen bank account expeditiously
  • Whether any legal impediment exists that would prevent a two‑month timeframe for disposal
