Allahabad High Court

DIGVIJAY YADAVversusSTATE OF U.P.

Decided

Holding

The High Court directed the trial court to decide the case within six months, without unnecessary adjournments.

Summary

The applicant, Digvijay Yadav, filed an application under Section 529 of the Criminal Procedure Code seeking an expeditious disposal of a pending criminal case (Case No. 46 of 2020) involving offences under Sections 392 and 411 of the Indian Penal Code. The charge sheet was filed in 2018, but the trial court had not yet framed charges against the accused, causing prejudice to the applicant. The State, represented by the Advocate General, raised no objection to the prayer. The High Court, after hearing counsel, directed the trial court to decide the matter within six months of receiving the certified copy of the order, barring any legal impediment and without unnecessary adjournments. The application was consequently disposed of.
