Allahabad High Court

SAURABH KUMARversusSTATE OF U.P. AND 6 OTHERS

Decided

Holding

The trial court must endeavour to decide the case expeditiously and avoid unnecessary adjournments.

Summary

The applicant, Saurabh Kumar, filed an application under Section 529 of the BNSS seeking an order for the speedy disposal of Sessions Case No. 254 of 2025, which involves multiple offences under the BNSS and the Arms Act. The case had been pending since 2024 without reaching a conclusion. The applicant’s counsel argued that the delay was unwarranted, while the State’s Additional Government Advocate raised no objection to the request. The High Court, after hearing counsel, directed the Special Judge handling the trial to make every effort to decide the matter promptly and to refrain from granting any unnecessary adjournments, provided there is no legal impediment. Consequently, the application was disposed of with the directive to the trial court.
