Allahabad High Court

RAMENDRA SINGH @ RAVINDRA AND ANOTHERversusSTATE OF U.P.

Decided

Holding

The Court held that the applicants are entitled to anticipatory bail under Section 482 of the CrPC as the circumstances do not warrant denial of bail.

Summary

The applicants, Ramendra Singh (also known as Ravindra) and Sanjay Kumar, filed an anticipatory bail application under Section 482 of the Criminal Procedure Code in a case involving alleged offences under Sections 191(2), 115(2), 352, 110, 117(2) and 118(1) of the Indian Penal Code. They claimed they were falsely implicated, had not been arrested during investigation, and possessed no prior criminal record. The State opposed the bail, alleging that the applicants participated in a brutal assault that caused grievous injuries, including fractured skull bones, to the complainant Ram Bharose. The Court noted the presence of conflicting versions of the incident, the seriousness of the injuries, but also observed that similar co‑accused had been granted anticipatory bail and that the applicants were not needed for further custodial interrogation. Balancing these factors, the Court decided that anticipatory bail was appropriate, subject to standard conditions. Consequently, the application was allowed and the applicants were directed to appear before the trial court and furnish a personal bond and surety.

Issues considered

  • Whether anticipatory bail should be granted to the applicants under Section 482 CrPC despite allegations of grievous assault.
  • Whether the existence of serious injuries and cross‑versions of the incident preclude the grant of bail.
  • Whether the applicants' lack of arrest and clean criminal record justify the issuance of anticipatory bail.

Court No. - 71
                 HON'BLE RAJIV LOCHAN SHUKLA, J.

1. Heard Learned counsel for the applicants, the Learned A.G.A. for the
State and perused the record.

2. The present anticipatory bail application has been filed on behalf of the
applicants in Case Crime No.50 of 2026, under Sections 191(2), 115(2), 352,
110, 117(2), 118(1) of the B.N.S., P.S.- Achhnera, District- Agra, with a
prayer to enlarge them on anticipatory bail as the applicants apprehend their
arrest in the above-mentioned case.

3. Learned counsel for the applicants has contended that the applicants have
been falsely implicated in the present case. There are cross versions and both
the sides claim to have received injuries. There are three injured in the
present case and two injured from the side of the applicants. Similarly
situation co-accused, Arvind Kumar and Pappu Singh, have been granted
anticipatory bail by this Court vide the order dated 25.09.2026 passed in
NABAIL No.10067 of 2026. The Learned counsel has further submitted that
the applicants were not arrested during investigation and now once a charge
sheet has been filed, they are no longer required for any custodial
interrogation or recoveries. They may be considered for grant of anticipatory
bail. The applicants have no criminal antecedents.

4. The Learned counsel for the informant and the Learned A.G.A. have
opposed the prayer for grant of anticipatory bail and have contended that
three people were brutally assaulted by the accused persons including the
applicants. The injured Ram Bharose has received injuries which were not

only grievous in nature but were dangerous to life as his parietal and
temporal bones were found fractured. The applicant Ravindra and the co-
accused Pappu had both assaulted the injured using a Fawda. The injuries
correspond to the weapons assigned and no indulgence may be granted to the
applicants.

5. I have considered the submissions made by the Learned counsel for the
parties and perused the material brought on the record.

6. It is not disputed that there are cross versions of the incident. Both the
sides claim to have received injuries. Grievous injuries have been found on
applicant No. 1. In his supplementary report, injury No. 5 which is a fracture
of the maxillary bone on the right side has been opined by the Doctor to be
grievous in nature. The injuries sustained by Ram Bharose have also been
opined to be grievous in nature. At present, it would not be appropriate to
hold as to which side is the aggressor. Similarly situated co-accused Arvind
Kumar and Pappu Singh have been granted anticipatory bail by this Court.
The applicants were not arrested during investigation and have no criminal
antecedents. Once a charge sheet has been filed, they are no longer required
for any custodial interrogation.

7. Taking into account all the facts and circumstances of the case and
without expressing any opinion on the merits of the case, I deem it fit to
enlarge the applicant on anticipatory bail.

8. In view of the above, the anticipatory bail application of the applicants is
allowed.

9. The applicants - Ramendra Singh @ Ravindra and Sanjay Kumar,
shall appear before the trial Court within four weeks from today and shall be
released on bail on filing personal bond and surety in the like amount to the
satisfaction of the Court concerned with the following conditions:-

i. The applicants shall remain present before the trial Court on each date
fixed unless exempted by the trial Court;

ii. The applicants shall not, directly or indirectly make any inducement,
threat or promise to any person acquainted with the facts of the case so as to
dissuade them from disclosing such facts to the Court or to any police
officer;
                                                                                          NABAIL No. 10184 of 2026
                                                                     3

                                    iii. The applicants shall not leave India without the previous permission of
                                    the Court;

                                    iv. The applicants shall not pressurize/intimidate the prosecution witness;

                                    10. In case of breach of any of the above conditions, the Court concerned
                                    shall be at liberty to cancel the bail.

                                    11. It is made clear that observations made hereinabove are exclusively for
                                    deciding the instant anticipatory bail application and are not to be considered
                                    to be an opinion on the merits of the case.
