Allahabad High Court

SHABANA PARVEENversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The court ordered that the applicant must apply for regular bail within four weeks and that no coercive action be taken against her during that period, thereby disposing of the anticipatory bail application.

Summary

The applicant, Shabana Parveen, filed an anticipatory bail application under Section 482 of the Criminal Procedure Code. The counsel requested that the applicant be allowed to approach the concerned court for regular bail and that his interests be protected in the interim. The opposing counsel raised no objection. The High Court directed that the applicant must appear before the concerned court within four weeks and apply for regular bail in the specified case, and that her bail application be considered expeditiously without being influenced by any prior rejection of the anticipatory bail. The court also ordered that no coercive action be taken against the applicant for a period of four weeks. The anticipatory bail application was consequently disposed of with these directions.

Issues considered

  • Whether the anticipatory bail application under Section 482 CrPC can be stayed pending the filing of a regular bail application
  • Whether the court can prohibit coercive action against the applicant during the interim period
